Stay positive, and happy mugging!
Our content policies play an important role in maintaining a positive experience for you, the users. Please respect these guidelines.
Adult Content: We do not allow adult content on MugStats, including images or videos that contain nudity or sexual activity.
Child pornography: We will terminate the accounts of any user we find publishing or distributing child pornography. We will also report that user to law enforcement.
Pedophilia: We do not allow content that encourages or promotes sexual attraction towards children. For example, do not create profiles with galleries of images of children where the collection of images or text accompanying the images is sexually suggestive.
Hate Speech: We want you to use profileger to express your opinions, even very controversial ones. But, don't cross the line by publishing hate speech. By this, we mean content that promotes hate or violence towards groups based on race, ethnicity, religion, disability, gender, age, veteran status, or sexual orientation/gender identity. For example, don't write a profile saying that members of Race X are criminals or advocating violence against followers of Religion Y.
Crude Content: Don't post content just to be shocking or graphic. For example, collections of close-up images of gunshot wounds or accident scenes without additional context or commentary would violate this policy.
Violence: Don't threaten other people on their profile. For example, don't post death threats against another person or group of people and don't post content encouraging your readers to take violent action against another person or group of people.
Personal and confidential information: It's not ok to publish another person's personal and confidential information. For example, don't post someone else's credit card numbers, Social Security numbers, unlisted phone numbers, and driver's license numbers. Also, please keep in mind that in most cases, information that is already available elsewhere on the Internet or in public records is not considered to be private or confidential under our policies.
Impersonating others: Please don't mislead or confuse users by pretending to be someone else. If you find that someone has falsely made an account with your name or picture, email us at firstname.lastname@example.org so we can remove it.
Illegal activities: Don't use profileger to engage in illegal activities or to promote dangerous and illegal activities. For example, don't author a profile encouraging people to drink and drive. Otherwise, we may delete your content. Also, in serious cases such as those involving the abuse of children, we may report you to the appropriate authorities.
Spam: Spam takes several forms in profileger, all of which can result in deletion of your account or profile. Some examples include creating profiles designed to drive traffic to your site or to move it up in search listings, posting comments on other people's profiles just to promote your site or product, and scraping existing content from other sources for the primary purpose of generating revenue or other personal gains.
Malware and viruses: Do not create profiles that transmit viruses, cause pop-ups, attempt to install software without the reader's consent, or otherwise impact readers with malicious code. This is strictly forbidden on profileger.
Enforcement of profileger's Content Policy If you encounter a profile that you believe violates our content policies, please report it to us at email@example.com

The parties hereby submit to the personal jurisdiction of the state and federal courts of the State of Connecticut. Exclusive venue for any litigation or arbitration permitted under this Agreement shall be with the state and federal courts located in Hartford County, Connecticut.
B. Rights to Injunctive Relief
Both parties acknowledge that remedies at law may be inadequate to provide an aggrieved party with full compensation in the event of the other party’s breach, and that an aggrieved party shall therefore be entitled to seek injunctive relief in the event of any such breach, in addition to seeking all other remedies available at law or in equity.
C. Binding Arbitration
If there is a dispute between the parties arising out of or otherwise relating to these Terms and Conditions, the parties shall meet and negotiate in good faith to attempt to resolve the dispute. Arbitral Claims shall include, but are not limited to, contract and tort claims of all kinds, and all claims based on any federal, state or local law, statute, or regulation, excepting only claims under applicable worker’s compensation law and unemployment insurance claims. If the parties are unable to resolve the dispute through direct negotiations, then, except as otherwise provided herein, either party may submit the issue to binding arbitration in accordance with the then-existing Commercial Arbitration Rules of the American Arbitration Association. The arbitrator shall render a written opinion setting forth all material facts and the basis of his or her decision within thirty (30) days of the conclusion of the arbitration proceeding. This Section shall not apply to any breach (or any allegation which if true would constitute a breach) of any matter relating to intellectual property. THE PARTIES HEREBY WAIVE ANY RIGHTS THEY MAY HAVE TO TRIAL BY JURY IN REGARD TO ARBITRAL CLAIMS.
The rights and liabilities of the parties hereto will bind and inure to the benefit of their respective assignees, successors, executors, and administrators, as the case may be. Neither these Terms and Conditions nor any rights granted hereunder may be sold, leased, assigned or otherwise transferred, in whole or in part by you.
If for any reason a court of competent jurisdiction or an arbitrator finds any provision of these Terms and Conditions, or any portion thereof, to be unenforceable, that provision will be enforced to the maximum extent permissible and the remainder of these Terms and Conditions will continue in full force and effect.

What Information is collected?
We collect two types of information: personally identifiable information ("PII") and non-personally identifiable information ("Non-PII"), which is also referred to as aggregate and anonymous data.
What information do you gather automatically from visitors?
What information will you ask me for?
When you establish an Ad Profile on the Website you will be asked for some general identifying information which will enable us to provide you with this individualized service. We gather contact information (e.g. your email address), and demographic information (e.g. city of residence or age). While register and creating a Profile, you will be given the option of creating a pseudonymous profile (email and password) where your gender is applicable. Personal information that may identify you is not permitted on your Profile. Please note, you may upload photos to your Profile. The type of photos you upload may clearly identify you.
How will this information be used and who has access to it?
Your Non-PII is used to personalize your experience, allow other members to find you through a search, to compose your personal profile - which is associated with a pseudonymous identity you have created - and to deliver targeted advertising and promotional offers to you from external companies that are of the highest relevance to your demographic profile. We may share some of this information for our own analysis and research purposes with our professional advisors or consultants and third party partners.
The PII we collect from you is used in the course of providing our service to you and to improve the content and functionality of our Website or customize the layout of our pages for each individual member. We may use your contact information to send you valuable updates and timely notices of promotions and mailbox status reports. We may also use your PII to send electronic mail to you, for the purpose of informing you of changes or additions to the Service, or of any MugStats products and services. The PII we collect may be released to non-affiliated third party without your prior. Our use of the PII we collect includes, but is not limited to, the following:
We may share PII about our users sometimes in connection with Non-PII with service providers that may be associated with us to perform functions on our behalf. In addition, from time to time we may share and/or sell PII about our users (such as your mailing or email addresses) with selected third parties, so they can offer goods and services that we believe may be of interest or benefit to our users.
We may disclose your PII to respond to law enforcement requests; or where required by applicable laws, court orders, or government regulations; or to protect against misuse or unauthorized use of our site; or to protect the personal safety or property of our users or the public (among other things, this means that if you provide false information or attempt to pose as someone else, information about you may be disclosed as part of any investigation into your actions).
Sale or Merger
We may disclose and sell PII in connection with the sale, assignment, or other transfer of the business or a portion of the business of our Website, including a corporate merger, consolidation, restructuring, sale of assets or other corporate change of our direct or indirect parent companies that affects us.
We may share much of our data, including PII about you, with our parent, subsidiary and other affiliated companies (each an "Affiliate") that are committed to serving your online needs and related services. To the extent that these entities have access to your PII information, they will give such information at least the same level of protection treat it at least as protectively as they give to treat information they obtain from their other users. Our Affiliates will follow privacy practices no less protective of all users than our practices described in this document, to the extent allowed by applicable law. It is possible that we or one or more of our Affiliates, or any combination of such, could merge with or be acquired by another business entity. In connection with the due diligence review involving such a potential transaction, we may share some or all of your PII with potential acquirers, merger partners or investors, and their agents (including professionals). We would require that these third parties sign non-disclosure agreements and would endeavor to disclose as little PII as possible. Should such a combination then in fact occur, you should expect that we would share some or all of your information in order to continue to provide the Service.
How long do you keep the information I've provided you?
We keep the information you have given us for at least as long as your Profile stays active.
Accessing and updating your email notification preferences, personal information and public information
Please be aware that it may take several hours for any changes you request to take effect. Please also note that changing or deleting your information will only change or delete the data in our database for the purpose of future activities and communications. These changes and deletions will not change or delete information or emails that are queued to be sent or have already been sent.
Do you monitor online behavior?
While we do not, as a rule, moderate or monitor activity, we reserve the right to do so if we suspect users of being under the age of 18 or of using our service for the purpose of solicitation or any other violation of our Terms & Conditions or Privacy Statement. Submissions that appear on the public area of the site are moderated and, if necessary, we reserve the right to edit, delete, remove or not use any communication on a public area of the site.
MugStats is based on answering specific questions based on a picture. For this reason, submitted pictures are viewable to all registered users. Although access is restricted, the pictures submitted are part of the public domain. Any individual's real name will not be associated with any given profile picture. Instead, a username will be associated with each profile picture to protect anonymity. The other information collected is used only for verification purposes when changing or deleting submissions.
Removal of information
If you wish to have a specific picture removed of yourself, this can be accomplished via the contact form or via email. You will need to provide the username of the account with the picture. Providing a URL to the image in question is sufficient. We cannot guarantee removal of a specific picture because information may be submitted falsely. Users can only request images of themselves to be removed. For requests for removal send an email to email@example.com.
Other Information Collectors
Except as otherwise expressly described in this Privacy Statement, this document only addresses the use and disclosure of information we collect from you. To the extent that you disclose your information to other parties, whether they are on our Website (including links to third party sites) or on other sites throughout the Internet, different rules may apply to their use or disclosure of the information you disclose to them. To the extent that we use third party advertisers or have third party e-commerce partners, they adhere to their own privacy policies. Since we do not control the privacy policies of any third parties, you should investigate their policies before you disclose your personal information to them.
We treat data as an asset that must be protected against loss and unauthorized access. To safeguard the confidentiality and security of your PII, we use industry standard practices and technologies.
